1. About Us and Acceptance

1.1. Introduction

These Terms of Use apply to your use of OyunOyna.com's website, mobile games, and other content, websites, and all related services (including servers, software, and infrastructure, henceforth "Service"). The use of the Service is also subject to OyunOyna.com's Privacy Policy or Mobile Applications Privacy Policy for web games, which can be found here, and for mobile games, which can be found here, as referenced in this document.

1.2. Acceptance of Terms

Please read the Terms of Use carefully before using the Service. By downloading, using, or otherwise accessing the Service, you accept the validity and content of these Terms of Use, as well as the applicable privacy policy. Certain parts of the Service, such as web pages where you download games or make payments for in-game credits, may contain additional terms and conditions belonging to us or our suppliers, licensors, or other third parties, which supplement these Terms of Use. By using these services, you agree to comply with such additional terms and conditions. 2. Registration and Account

2.1. License and Usage

Subject to your acceptance of and continued compliance with these Terms of Use, OyunOyna.com grants you a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to access and use the Service for your own non-commercial entertainment purposes, subject to the following limitations.

OyunOyna.com offers numerous and varied games on its portal and on other platforms such as app stores. These games are free unless otherwise stated. However, you are solely responsible for all expenses that may arise during your use of the Service over wireless service or other communication services. In certain games, you can purchase virtual items (such as virtual game items or virtual tokens) or subscriptions for game downloads. To process payments made on OyunOyna.com's websites or another platform, OyunOyna.com may use third-party payment providers as stated in Section 6.

2.2. Account Creation Age Limit

You can create an account on the Service ("Account"). By creating an Account, you confirm that you are 16 years of age or older.

2.3. Username and Account Security

A username is a unique identifier either chosen by you or provided by us to identify you on the Service. You may only have one Account on OyunOyna.com's websites and one Account per game. OyunOyna.com reserves the right to delete any of your Accounts if you have more than one. You cannot sell, rent, or give your Account to others, create an Account with false identity or information, or do this on behalf of someone other than yourself. If your Account has been accessed without your permission, please notify us immediately and change your login information. The protection of login information confidentiality and all purchases made through your Account, whether with or without your permission, are solely your responsibility. If you have provided us with contact information, you are required to keep it accurate and up-to-date. You may only use your Account for non-commercial purposes.

2.4. Account Inactivity and Termination

OyunOyna.com reserves the right to terminate and permanently deactivate your Account if it has been inactive for 180 days. In case of deactivation, we have no obligation to retain or provide information or content associated with your (former) Account or to refund payments made through your (former) Account, and your former username may be allowed to be taken and used by another user. Additionally, we have no obligation to delete public data, content, or other information that you have uploaded or shared on or through the Service.

2.5. Account Restrictions for Non-Compliance

In case you do not comply with the Terms of Use or OyunOyna.com suspects this, or in case of illegal or inappropriate use of the Service or suspicion thereof, OyunOyna.com may, without prejudice to other remedies available, limit, suspend, terminate, modify, or delete accounts or access to the Service or parts of the Service without notice to you. OyunOyna.com is not obligated to compensate for any losses or consequences in this regard, including but not limited to advantages, privileges, or virtual items connected with your use of the Service.

3. User Content

3.1. General Disclaimer

The Service may include player content such as messages, wall posts, opinions, comments, pictures, or graphics (henceforth "User Content"). We do not have an active role in the creation or publication of such User Content; no User Content is endorsed by us, and we do not guarantee that such content does not infringe on third-party rights or is not illegal (in any way). The risks arising from the use of the Service are your responsibility. By using the Service, you may be exposed to User Content that is offensive, inappropriate, or contrary to your expectations. All risks related to your use of existing User Content connected with the Service are yours. OyunOyna.com is not responsible for User Content and has no obligation regarding it. However, we would be pleased if you report any inappropriate User Content you encounter to support@oyun-oyna.com. Subsequently, we may take measures we deem appropriate under the circumstances and entirely at our discretion in response to the reported User Content.

3.2. User Content License

If you submit User Content yourself, you grant OyunOyna.com a non-exclusive, irrevocable, perpetual, transferable, fully paid, royalty-free, worldwide license (including the right to sublicense and assign to third parties) to use, publish, reproduce, distribute, edit, create derivatives of, or otherwise exploit this submitted User Content in any kind of media format currently known or developed in the future. To the extent permitted by applicable laws, you hereby waive all moral rights, publicity rights, or privacy rights you may have in connection with such User Content.

3.3. Ownership and Right to Monitor

Without prejudice to 3.2, the possible ownership of your User Content will remain with you. We reserve the right to monitor all User Content and your activities in connection with the Service, but it is not possible for us to monitor all User Content or to preview it, and we do not attempt to do so. We reserve the right to edit, refuse to publish, or delete User Content published on the Service entirely at our discretion, for any reason and at any time, but we have no obligation to do so.

3.4. User Content Submission Guarantees

If you submit User Content to the Service:
You understand and accept that every user of the Service may have access to such User Content and that OyunOyna.com has no control over this information or how users use it; You guarantee that you are authorized to submit the content and grant OyunOyna.com the license specified in 3.2, that the content does not infringe any third-party rights, including but not limited to intellectual property rights, and does not violate applicable law. You will protect OyunOyna.com against third-party claims (which may include official authorities), related expenses, and damages that may arise in this context.

3.5. Cooperation and Indemnification

You will cooperate with OyunOyna.com upon first request when it comes to investigating any illegal, fraudulent, or inappropriate User Content (whether created by you or another player) or other activities on the Service. In disputes with Service users or other third parties, you will protect OyunOyna.com, its officers, directors, agents, subsidiaries, partners, and employees against all claims, related expenses, and damages that may arise on or in connection with the Service.

4. Advertisements and Third-Party Content

4.1. Advertisements

While offering you games on the Service, we may show you advertisements before, after, or during such games. Any relationships you may enter into with advertisers through our Service are between you and the advertiser. OyunOyna.com is not responsible for your loss or claim against any advertiser.

4.2. Third-Party Links

The Service may contain links to third-party websites, including links provided as automated search results. The existence of such links does not imply that we endorse these third-party sites or services. You understand and accept that we are not responsible or liable for any content or material on these third-party sites.

5. Behavior on the Service

5.1. Permitted Use

You may use the services provided through the Service only for legal, personal, and non-commercial purposes. In cases where content is available for download, such content may only be downloaded for personal use and may not be reproduced or distributed. All downloads are subject to the rules provided with the content.

5.2. Prohibited Actions

You may not:
Engage in actions that OyunOyna.com considers contrary to the spirit or purpose of the Service;
Use cheats, programs to gain unauthorized access, automation software, bots, hacks, modifications, or any unauthorized third-party software designed to modify or interfere with the Service;
Use the Service in a way that exceeds the usage rights provided to you;

Reproduce, copy, edit, display, modify, translate, redirect, publish, (sub)license, transfer, or otherwise distribute or exploit content available on the Service without our prior written permission;

Attempt to circumvent mechanisms included in the Service to prevent unauthorized reproduction or distribution of the Service's contents.

5.3. Prohibited Content and Materials

Through the Service, you cannot send or transmit or participate in sending or transmitting any information, content, or material that:
Infringes or violates others' rights, including but not limited to patent, trademark, trade secret, copyright, publicity, or other proprietary rights;
Is illegal, threatening, harassing, annoying, defamatory, libelous, deceptive, false/fraudulent, invades another's privacy, dishonest, contains obscene expressions about sexual acts, or is pornographic;
Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
Impersonates anyone, including OyunOyna.com and its employees and agents, a business, or an organization;
Contains viruses or any other computer code, files, or programs that disrupt, eliminate, or limit the functionality of any software, hardware, or telecommunications equipment, or in any way allow unauthorized use of a computer or computer network, or contains any other computer codes, files, or programs;
Encourages an act that constitutes a criminal offense or would create legal liability; or
Otherwise violates these Terms of Use, guidelines, or any policy shared on the Service.

OyunOyna.com reserves the right to determine which behaviors it considers violations of the Terms of Use or in any way contrary to the purpose and spirit of these Terms of Use. OyunOyna.com reserves the right to take measures as a result, including terminating your Account and completely or partially prohibiting your use of the Service.

6. Virtual Items and In-Game Purchases

6.1. Paid Services License and Purchase

Provided you have a registered Account on the Service and within certain games on the Service, you can purchase a limited, personal, non-transferable, non-sublicensable, revocable license for virtual items (such as a virtual game item or virtual tokens), game progress, or a game subscription (download) (henceforth collectively referred to as "Paid Services"). You can only purchase Virtual Items through the Service from us or our authorized partners, not in any other way. OyunOyna.com may manage, regulate, control, remove, or change the price of virtual items and/or services at any time, with or without notice. OyunOyna.com will not have any liability to you or any third party when exercising such rights. Transfers of virtual items are prohibited unless explicitly permitted in the Service. Except as explicitly permitted in the Service, you cannot sell, license, or otherwise transfer virtual items to OyunOyna.com, another user, or any third party or organization.

All purchases made through the Service require you to enter into a contract to make the payment either with OyunOyna.com or with the relevant Payment Service Provider (PSP) (you will see which PSP you are making the transaction with on the payment screen). As a parent/legal guardian, you are responsible for all payments made in the Service using credit cards or other payment methods (e.g., phone, SMS, PayPal) by a minor.

6.1.1. Contract with PSP

If the contract is made with a PSP, OyunOyna.com will not be held responsible in any way for communication between you and the PSP, and all information you share with the PSP will be subject exclusively to that PSP's privacy policy and/or other terms and conditions. Some PSPs may allow pre-approved recurring payments, and you accept any terms and conditions that the PSP may have established for recurring payments. To avoid doubt, OyunOyna.com is not and will not be part of a contract you make with a PSP. By using a PSP for payments related to the Service, you agree to protect and indemnify OyunOyna.com against earned payments or other claims that the PSP may have as a result of non-payment. If you pay by credit card, you may choose to enable the one-click payment option if your credit card provider offers this option. By enabling or using this option, you accept all terms and conditions set by the payment provider and your credit card provider for the use of this option. OyunOyna.com accepts no responsibility for the use of this payment option.

6.1.2. Payment Information and Taxes

All information we receive from you in the context of payments and service provision in the Service is subject to the relevant OyunOyna.com privacy policy. You agree to pay all applicable taxes and expenses associated with your Account or the use of an Account registered by someone else on your behalf.

6.2. No Cancellation and Refund Right

If you purchase Paid Services through the Service, you will not have the right to cancel your purchase and request refunds, as your use begins with the supply, regardless of when you first use the virtual items in the game.

6.3. Right to Change Paid Services

OyunOyna.com and/or its licensors may manage, regulate, control, modify, or remove the Paid Services at any time, with or without notice. OyunOyna.com and/or its licensors will not be liable to you or any third party in such a case.

6.4. Cancellation and Refund Policy for Paid Services

After payment for a Paid Service, there is no right to a refund. OyunOyna.com reserves the right to cancel and delete all or part (the balance) of the Paid Services you have purchased in the Service in the following cases:

If you do not use your Account for a continuous period of 180 days, as specified in 2.4; If we no longer offer the content or Service to which the Paid Services (balance) is linked, subject to prior notice from OyunOyna.com in this regard; If you do not comply with these Terms of Use. In this regard, there is no right to a refund or other form of compensation for unused Paid Services.

If the Paid Service becomes unavailable after the purchase but before the download, your only recourse is limited to a refund of the fee paid for the unavailable virtual product. If technical problems prevent or unreasonably delay the delivery of your virtual product, your only recourse is product exchange or a refund of the fee paid, as determined by OyunOyna.com.

Returns of products other than virtual products (for example, virtual goods, subscriptions, and game progress are virtual products) purchased through the Service are only accepted if these products and their packaging are in original condition and returned within thirty (30) days after being sent to you. When we send you physical products, we will include a return authorization form that you should use when sending anything to us. Virtual products cannot be returned and do not include refunds, except at our sole and absolute discretion.

7. Proprietary Rights

7.1. General Ownership

The Service includes various content, brands, data, works, and materials of OyunOyna.com and third parties, including but not limited to logos, trademarks, look and feel elements, trade names, software, games, layouts, information, texts, data, music, images, writings, designs, graphics, button icons, instructions, and drawings (henceforth referred to as "Contents").

Unless otherwise stated in writing, all Contents are owned, controlled, or licensed by OyunOyna.com or its licensors. All Contents are protected by copyright laws and/or other intellectual property laws against unauthorized use. Trademarks, logos, and designs cannot be used without OyunOyna.com's express written permission. You cannot copy, redistribute, publish, or otherwise exploit any Content in a way that would infringe on the intellectual property rights of OyunOyna.com or any third party.

Notwithstanding anything to the contrary herein, you understand and accept that you have no ownership or proprietary rights in the Account. All rights associated with and in the Account will remain the property of OyunOyna.com and will be in its favor.

7.2. Downloadable Content License

We may offer you Contents to download or use. These Contents will be subject to the terms of the license agreement for such Contents. In the absence of any license agreement provided with the Content, your use of the said Content will be subject to the following license in addition to the other terms of these Terms of Use. You are granted a personal, non-exclusive, non-transferable, limited license to install the Contents on a single computer. The Contents are protected by copyright and other intellectual property laws and agreements and belong to us or our licensors. You cannot sell or redistribute the Contents. You cannot incorporate the Contents or any part of them into another product. You cannot reverse engineer, decompile, or disassemble the Contents or attempt to obtain its source code (except where explicitly permitted by law). You cannot modify, adapt, or create derivative works from the Contents or remove proprietary notices from the Contents in any way. You agree to comply with all applicable laws and regulations regarding your use of the Contents. You cannot authorize or assist any third party to carry out actions prohibited in this paragraph. We may automatically check the version of the Contents and update them to improve their performance and features. If you close the Contents during an automatic update or otherwise interfere with the installation of the update, the contents may be damaged and/or not work.

7.3. Updates

The Service is constantly being modified, and OyunOyna.com may require you to accept updates to the Contents and the Service. Such updates may be carried out with or without notice to you.

8. Warranty Disclaimers and Limitation of Liability

8.1. Warranty Disclaimers

The Service is provided AS IS, with all its errors and as available. We and our licensors make no express obligation or warranty representation about the Service. OyunOyna.com is not obligated to provide any support. Implied obligations that the Service is merchantable, of satisfactory quality, accurate, current, and suitable for a particular purpose or need and non-infringing are rejected by our suppliers and us to the extent permitted by law. It is not guaranteed that the Service will meet your needs or be error-free, reliable, uninterrupted, or always available. We do not guarantee that the results that may be obtained from the use of the Service (including support services) will be effective, reliable, or accurate or will meet your needs. We do not guarantee that you can access or use the Service (directly or through third-party networks) at any time or place you want. No verbal or written information or opinion given by a representative of OyunOyna.com will constitute a warranty. You may have additional consumer rights under your local laws that this agreement cannot change and that OyunOyna.com will comply with.

8.2. Exclusive Remedy and Limitation of Liability

The sole and exclusive remedy for any dispute you may have with us is to stop using the Service. Our liability (or the liability of our parent company or suppliers) for all claims related to the use of the Service cannot in any way exceed the total amount of payments you have made to us within six (6) months following the event giving rise to the dispute. In case you have not made any payments to OyunOyna.com within this period, the sole remedy for any dispute you may have with OyunOyna.com (and OyunOyna.com's exclusive liability) is to stop using the Service and deactivate your Account. If applicable laws deem such a remedy insufficient, OyunOyna.com's liability will be 500 Euros or the minimum amount prescribed by law, whichever is less. OyunOyna.com, ITS AFFILIATES, SUPPLIERS, AND LICENSORS HAVE NO LIABILITY TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFIT, LOSS OF DATA, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES (HOWEVER SUCH LOSSES MAY BE CHARACTERIZED) ARISING FROM YOUR ACCESS TO AND USE OF THE SERVICE AND YOUR RIGHTS UNDER THESE TERMS OF USE OR APPLICABLE ADDITIONAL TERMS, EVEN IF OyunOyna.com HAS BEEN ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES, REGARDLESS OF WHETHER THE CONSEQUENTIAL CLAIM IS BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. Since some countries, states, or jurisdictions do not allow exceptions or limitations on liability for consequential or incidental damages, in such countries, states, or jurisdictions, our liability (and the liability of our parent company and suppliers) will be limited to the extent permitted by law.

8.3. International Use

We make no representation that the Service is suitable or available for use outside the Netherlands. If you choose to access the Service from a location outside the Netherlands, you do so at your own initiative and are responsible for compliance with local laws.

The above does not affect the liability limitations and indemnities elsewhere in these terms and conditions.

8.4. Intellectual Property Infringement Notice

If, in your opinion, any copyright or other intellectual property right (IP right) you own is infringed by or on the Service, please inform us immediately and provide us with the following:

An electronic or physical signature of the IP right owner or a person authorized to act on their behalf.
A description of the IP right you claim has been infringed and a description of the infringing action.
The location where the original or authorized copy of the copyrighted work can be found (for example, the URL of the website where it was posted or the name of the book in which it was published, or if there is a trademark name, an excerpt from the registration to prove the existence of the registration).

If you are not the owner of the IP right, a copy of the license that gives you the right to use and protect this IP right.
The identification of the URL or other specific location of the material you claim is infringing. This information must be clear enough to allow us to locate this material.
Your name and complete contact information.

Your statement of sincere and honest belief that the use in question is not authorized by the copyright owner, their agent, or the law.

9. Indemnities

Notwithstanding and without prejudice to your full responsibility or indemnity obligations stated in this Agreement, OyunOyna.com cannot be held liable for any loss or other special, incidental, indirect, consequential, or punitive damages.

At our request, you agree to defend, indemnify, and protect us and our parent organization, as well as other affiliated companies along with their employees, contractors, officers, directors, and representatives against any liability, claim, and expense, including attorneys' fees, arising in connection with your use or misuse of the Service. We reserve the right to assume, at our expense, the exclusive defense and control of any matter to be indemnified by you. In such cases, you agree to cooperate with us during the presentation of any available defense.

10. Miscellaneous

10.1. Entire Agreement

This agreement and all supplementary terms, policies, rules, and instructions published on the Service constitute the entire agreement between you and us and supersede all previous written or verbal agreements. If any part of these Terms of Use is found to be invalid or unenforceable, that part will be interpreted in accordance with applicable law and as much as possible to reflect the original intentions of the parties, and the remaining parts will remain in force.

10.2. Electronic Notifications

You agree that we may provide you with required notifications, agreements, and other information related to the Service electronically. If you no longer wish to receive notifications electronically, please stop using the Service and/or delete the Service from your computer or device.

10.3. Changes to Terms

These Terms of Use may change, but in such a case, we will inform you through the Service. The latest version of these terms will always be accessible through the Service. It is your responsibility to regularly check if there have been changes to the Terms of Use. If you continue to use the Service after changes to these Terms of Use, you indicate that you accept the new terms.

10.4. Applicable Law and Dispute Resolution

These terms and conditions are subject to the laws of the Netherlands. All claims or disputes that may arise in connection with these terms and conditions or the use of the Service will be submitted to the competent court in Amsterdam, the Netherlands, unless otherwise accepted by OyunOyna.com and/or unless there is another dispute resolution forum under mandatory consumer law. In case a dispute arises between you and OyunOyna.com, we recommend that you first contact us directly to seek a solution. You can reach us at support@oyun-oyna.com.

10.5. Force Majeure

OyunOyna.com will not be considered in breach of its obligations hereunder if there is any termination, interruption, or delay in the performance of its Force Majeure obligations due to causes beyond its control, including but not limited to earthquakes, floods, and other natural disasters, labor disputes, civil unrest, war (whether officially declared or not), or the inability to obtain adequate supply, transportation, and other essential goods or services necessary to continue business operations, or any amendment, regulation, or change in any law, regulation, decree, or ordinance.

10.6. Injunctive Relief and Waiver

You agree that the rights granted to OyunOyna.com and obligations imposed under these Terms of Use are unique and irreplaceable, that their loss would cause irreparable harm to OyunOyna.com, and that monetary compensation alone may not be sufficient, thus in the event of any breach or anticipated breach by you, OyunOyna.com will be entitled to injunctive or other equivalent relief (without the need to show any bond, guarantee, or proof regarding such damages).

You irrevocably waive any right to request or demand the operation or restriction of the Service and any game on OyunOyna.com, advertisements published in connection with them, or Services or any content or material used or displayed through the Service or via the Service, and all rights to obtain an injunction or equivalent relief, and agree to limit your claims to monetary compensation.
